This Privacy Policy regulates the processing of personal data of users and customers (hereinafter "Users" and "Customers") collected, within the scope of the use of the Quinta da Bordaleira website (hereinafter "Website"), by Vinocult, Lda. and reflects its concerns regarding the privacy and processing of Users and Customers' personal data.

The provision of personal data in the context of browsing the Site implies knowledge and express acceptance of the conditions contained in the Privacy Policy and Cookies Policy.

 

Use of the Site

Users may browse the Site anonymously, without providing any personal information. The visit to the Site, by itself, does not imply the automatic registration of any personal data that identifies the User.

Collection and Processing of Personal Data

In order to access and use certain features of the Site, namely ordering products online, the User must previously register, by creating a personal account, which implies providing some personal data.

Non-registered Users will be able to browse the Site freely and view the products available for ordering, as well as other content made available by Vinocult, Lda..

Vinocult Ltd. is the entity responsible for processing the personal data of Users, and processes this data, and may, in certain cases, resort to subcontracted entities for the provision of services and technical support, which may have access and process data for this purpose, under the terms of the contracts entered into between Vinocult, Lda. and these entities.

The personal data collected will be processed and stored by computer by Vinocult, Lda., or by external entities subcontracted by it, for the purpose of providing services, and are intended to manage the registration of Users and Customers on the Site and the use of functionalities of the Online Store, namely, the processing of orders from Customers and the delivery of products requested by them.

The data will also be processed for the purposes of communication with Users and Customers, namely to respond to requests for information and clarification, complaints and requests for reimbursement, as well as comments and/or suggestions that they address to Vinocult, Lda..

Additionally, Vinocult, Lda. will have access to the Customers' purchase history and will be able, if necessary to confirm the payment of the order or resolve any resulting issues, access data relating to financial transactions provided by the entities that manage the means of payment.

Vinocult Ltd. may also process, with the consent of the User, the personal data concerning him for the purposes of direct marketing and dissemination of its products and services, through any communication channel, namely through email messages, SMS, MMS or other forms auto call.

In this context, the following personal data may be collected: first name and surname, tax identification number, address, postal code, location, telephone contact and e-mail and Customer purchase history.

Users and Customers may subscribe to the Quinta da Bordaleira newsletter, subject to their consent, in which case they will be asked for their e-mail address.

Personal data collected through the Site will be treated under the terms described herein, as well as for the purposes of fulfilling Vinocult, Lda.'s legal obligations.

Vinocult Ltd. assumes that the data collected was entered by the respective holder and/or that its insertion was authorized by the same, being true, current and accurate, especially regarding the legal age for the purchase and consumption of alcoholic beverages.

Vinocult Ltd. resorts to other entities to provide certain services. Eventually, this provision of services may imply access, by these entities, to the personal data of their Users and Customers.

Thus, any subcontracting entity of Vinocult, Lda. will treat the personal data of our Users and Customers, in the name and on behalf of Vinocult, Lda., in the strict obligation to follow our instructions. Vinocult Ltd. ensures that such subcontracting entities offer sufficient guarantees for the execution of appropriate technical and organizational measures so that the processing meets the requirements of the applicable law and ensures the security and protection of the rights of data subjects, under the terms of the subcontracting agreement entered into with the said subcontracting entities.

In certain situations, the personal data of Users and Customers may also be transmitted to third parties, when such data communications are necessary or appropriate (i) in light of the applicable law, (ii) in compliance with legal obligations/court orders, ( iii) by determination of the National Data Protection Commission or another competent control authority, or (iv) to respond to requests from public or governmental authorities.

In any of the situations mentioned above, Vinocult, Lda. undertakes to take all reasonable measures to ensure the effective protection of the personal data it processes.

 

Conservation of Personal Data

Your personal data necessary for the purposes of processing your orders and purchases will be kept for the period in which your relationship as a User or Customer is in force or as long as you keep your online account active, and may be kept for a longer period, established by law (for example , 10 years in the case of billing and accounting documents) or for the defense of rights/interests in legal proceedings.
