The use of the Quinta da Bordaleira Website as well as the purchase of products in the Quinta da Bordaleira Online Shop is subject to the following general terms and conditions of use and contracting (“Terms and Conditions”).

The content of the site www.quintadabordaleira.com (“Site”) is owned by Vinocult, Lda., headquartered at Rua Albertino Fontes – Outeiro, Pereiro, Tourais e Lages, 7040-121, Seia, Guarda, registered at the Commercial Registry Office under the unique registration number and legal person 513 987 517.

Purpose and scope

The purpose of these Terms and Conditions is to define the rules of use and contracting through the Site and apply to visitors to the Site (“Users”) and to any transactions of a commercial nature carried out through the Online Shop of Quinta da Bordaleira (“ Online Shop”) with buyers (“Customers”).

Browsing the Site, as well as purchasing any product on the Online Shop, implies acceptance of these Terms and Conditions by the User or Customer.

Vinocult Ltd. reserves the right, at any time, without prior notice and with immediate effect, to unilaterally modify the presentation and configuration of the Site and the conditions required to access and/or use the Site.

Vinocult Ltd. reserves the right, at any time, without prior notice and with immediate effect, to change, add or unilaterally revoke, partially or totally, these Terms and Conditions. Any changes will be immediately published on this same page online, so it is advisable to regularly consult this page for the necessary update.

Conditions for accessing and using the website

Access to the Site is free of charge and does not require prior subscription or registration by the User.

Alcoholic beverages available for sale in the Online Shop can only be purchased by individuals who are of legal age to do so in their country of residence (18 years in Portugal) and who do not have any impediment and/or legal restriction that prevents them from purchasing alcoholic beverages.

Vinocult Ltd. does not guarantee the availability and continuity of operation of the Site and services and excludes any liability for damages of any nature that may be due to the lack of these.

Vinocult Ltd. reserves the right to refuse or withdraw access to the Site or services, at any time and without the need for prior notice, on its own initiative or that of a third party, to those Customers and Users who do not comply with these Terms and Conditions and/or or applicable law.

Content information

Vinocult Ltd. reserves the right to unilaterally modify, at any time and without prior notice, the information and commercial offer presented on products, prices, promotions, commercial conditions and services, namely any description, image or other information from the catalogue of the Quinta da Bordaleira’s Online Shop.

The use of the Site for abusive purposes, and without prior authorization, is subject to recourse to the competent legal means by Vinocult, Lda..

All contractual information is written in Portuguese, as well as the information on the articles, email communications and formalization of the sale. Any translation of the Terms and Conditions and other contractual elements into another language is for information purposes only, with the Portuguese language version prevailing for all legal purposes.

 

Intellectual and industrial property

All existing elements on the Site, namely texts, images, illustrations, graphics, files, layout, structure, among others, are duly protected by the legal provisions relating to intellectual property and, in particular, by the scope of protection of copyright. In this way and under the terms of the Code of Copyright and Related Rights (approved by Decree-Law n.º 63/85, of March 14, in its current wording), its use will only be authorized for private purposes, without prejudice to more restrictive provisions contained in the legal text referred above. Any total or partial reproduction or representation of the Site or of all or part of the elements included therein is strictly prohibited, under penalty of resorting to the competent legal means against those who act in this way.

The aforementioned elements cannot be copied for commercial use or distribution, nor be modified or sent to other sites, without prior authorization from Vinocult, Lda. This site may also contain images that constitute the intellectual property of third parties, who are also, subject to the legal provisions applicable to the protection of copyright and intellectual property.

Corporate names, brands, as well as any distinctive signs reproduced on the Site are protected under the terms of the legal provisions applicable to industrial property. The reproduction or representation of all or part of these distinctive signs is strictly prohibited.

Obligations of Customers and Users

The Customer and the User undertake to comply with and respect these Terms and Conditions, in particular:

• make responsible use of the Site;

• not to attack or illegally use the Site's systems, not to access information in restricted and unauthorized areas, not to change the Site's content, nor to test and/or assess the vulnerability of the system;

• refrain from introducing, storing or disseminating through the Site defamatory, obscene, abusive, xenophobic and/or any other content that violates the general principles of law and public order;

• keep secret the access code(s) and name(s) of the user(s) assigned to access the private area of ​​the Site or certain features of the Site, as the case may be.

The User and the Customer will be liable for damages of any nature that Vinocult, Lda. may suffer as a result of non-compliance with any of the obligations to which they are subject under the terms of the law.

Online Shop

Online ordering

To make a purchase on the Online Shop, the User must provide the necessary Customer data.

Then, the Customer can place his order, selecting the desired products. The Customer must follow all the steps described on the Site for the order to be completed successfully.

The validation of the purchase order presupposes that the Customer is aware of and expressly accepts these Terms and Conditions. The data recorded by the Online Shop constitute proof of the set of transactions carried out between Vinocult, Lda. and the Customer.

Once the purchase is completed, the Customer will receive an automatic email confirming the transaction. If the data is not correct, you should immediately ask for its change.

Product availability

Items for sale at the Quinta da Bordaleira Online Shop are subject to existing stock and orders will be processed on a first-come, first-served basis.

In the event of temporary or definitive stock outages, the Customer will be duly informed, and an alternative product with similar characteristics will be suggested.

Prices

Product prices are indicated in € (euros) and include VAT at the legal rate in force in mainland Portugal.

All prices available in the Online Shop can be changed without prior notice and the respective products are always subject to the possibility of stock outages.

The prices and promotions carried out in the Online Shop are independent of those applied in the physical shop of Quinta da Bordaleira or at other points of sale where Quinta da Bordaleira products are sold.

Shipping costs

The value of shipping costs is calculated according to the weight of the products, the destination and the total value of the order. This value is indicated in the shopping cart before the final validation of the order or in the order confirmation email, if applicable.

Payment method

Vinocult Ltd. provides the Customer with the following payment methods: Paypal reference, VISA, Mastercard, MBway or bank transfer.

When applicable, after receiving the data relating to the order, the Customer has 48 (forty-eight) hours to make the payment. If you do not do so within this period, the order will be cancelled.

Delivery

Orders will only be shipped after confirmation of stock and payment.

Delivery of orders will be made to the address indicated by the Customer and in accordance with the carrier's delivery times.

Home delivery cannot be made to PO Boxes. Orders can be delivered abroad as long as the address is within the carrier's delivery area.

Vinocult Ltd. undertakes to deliver the ordered items as soon as possible.

All orders shipped by Vinocult, Lda. must be examined by the customer upon receipt. If any irregularity or damage to the product is detected, the Customer must return it to the carrier, justify the reason for the return on the delivery note and immediately inform Vinocult, Lda. via email sales@quintadabordaleira.com.

Returns and Refunds Policy

The Customer may exercise the right of free withdrawal under the legally established terms and indicated below, namely in Decree-Law no. 24/2014, of February 14, in its current wording.

The Customer may exchange or return (termination of the contract) the product(s) within a period of 14 (fourteen) calendar days from the date of receipt) without the need to indicate the reason and without payment of compensation. .

The period of 14 (fourteen) days begins to count from the day following the day: (i) on which the Customer or a third party appointed by him, other than the carrier, acquires physical possession of the product(s) or in the case (ii) where the Customer or a third party indicated by him, other than the carrier, acquires physical possession of the last product when the Customer has ordered several goods in a single order and the goods are delivered separately.

In order to exercise its right of free termination, the Customer must communicate its decision to terminate this contract by means of an unequivocal statement (for example, letter sent by post or email), to the contacts indicated above in these Terms and Conditions.

In order for the free termination period to be respected, it is sufficient that the communication regarding the exercise of the right of free termination be sent to Vinocult, Lda. before the expiry of the withdrawal period.

The Customer must return the product(s) without undue delay and no later than 14 (fourteen) days from the day on which he informed Vinocult, Lda. of the free termination of the contract, considering that the same is respected if the Customer returns the goods before the end of this period of 14 (fourteen) days.

The costs of returning the goods will be borne in full by the Customer, with the exception of cases in which Vinocult, Lda is responsible for the return.

Upon return, the product(s) (including the packaging accompanying the product(s), labels and back labels) must remain intact. Otherwise, the return is void.

Once the product(s) has been received at Vinocult, Lda. and after validating the status of the item(s), the Customer will be reimbursed for all payments made, including delivery costs (with the exception of additional costs resulting from your choice of a shipping method other than the least expensive method of standard shipping offered by us).

The refund will be made through the same payment method used by the Customer in the initial transaction or by bank transfer to the IBAN to be indicated by the Customer, if the payment method used does not allow it.

The costs incurred by the Customer to return the products to Vinocult, Lda. will not be refunded.

Applicable legislation and competent jurisdiction

All purchases made on the Site are subject to Portuguese law. The eletronic Book of Complaints is available at https://www.livroreclamacoes.pt/Inicio/. Any conflict or divergence of interpretation of the Terms and Conditions will be submitted to the competent Portuguese court.

If the Customer is located outside mainland Portugal, Vinocult, Lda. informs that any judicial process must be forwarded to the Portuguese courts.
